Terms of Service
Please read these terms carefully before using Fameclerk.
Last updated: February 26, 2026
Welcome to Fameclerk ("we," "us," or "our"). By accessing or using our website at Fameclerk.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.
Fameclerk is an online marketplace that facilitates the buying and selling of social media accounts across platforms including YouTube, Instagram, TikTok, X (Twitter), and Telegram. We provide escrow services, an internal credit system, and a secure messaging platform to enable safe transactions between users.
Definition of Digital Assets
For the purposes of these Terms, "Digital Assets" refer exclusively to social media accounts, groups, pages, and channels listed for sale or purchase on the Platform. Digital Assets do not include any social media engagement or manipulation services (e.g., likes, followers, views, comments), which are strictly prohibited.
1. Eligibility
- You must be at least 18 years of age or the legal age of majority in your jurisdiction to use Fameclerk.
- By registering, you represent that you have the legal capacity to enter into binding agreements.
- You must provide a valid email address and verify it before accessing platform features.
- Each person may register only one account. Creating multiple accounts may result in permanent suspension.
2. Account Registration & Security
- You must provide a unique username and a valid email address during registration.
- You may also register or log in using Google OAuth.
- You are solely responsible for maintaining the confidentiality of your login credentials, including your password and any two-factor authentication (2FA) recovery codes.
- We strongly recommend enabling two-factor authentication via your account settings for added security.
- You must notify us immediately if you suspect unauthorized access to your account.
- We reserve the right to suspend or terminate any account that we believe has been compromised, is involved in fraudulent activity, or violates these Terms.
3. Listings & Marketplace
3.1 Creating Listings
- Sellers may list social media accounts for sale on the following platforms: YouTube, Instagram, TikTok, X (Twitter), and Telegram.
- All listings are subject to review and approval. We reserve the right to reject any listing for any reason, including but not limited to inaccurate information, suspected stolen accounts, or policy violations.
- Sellers must provide accurate and truthful information including the account handle, audience count, platform data, pricing, and category.
3.2 Listing Duration & Promotions
- Listings are active for 90 days from the date of approval. After 90 days, the listing expires automatically.
- Bumping ($1) — Moves an active listing to the top of the browse page.
- Featuring ($50) — Showcases an active listing on the homepage for 30 days. Requires a listing price of at least $250.
- Pinning ($25) — Pins an active listing to the top of its platform page for 30 days. Requires a listing price of at least $50.
- Bumping, featuring, or pinning a listing will reset its expiry timer to 90 days from the date of the action.
- Once a listing expires, the seller must re-verify account ownership to relist it.
3.3 Making Offers
- Buyers may submit offers on active listings. All offers are binding expressions of intent to purchase at the offered price.
- Offer amounts must be between 50% and 200% of the listed price.
- Each buyer may have only one active offer per listing at a time.
- Sellers may accept or reject any offer at their sole discretion.
- When an offer is accepted, the buyer is notified and may proceed to initiate and fund the escrow.
- You must have a verified email address to submit offers or make purchases.
3.4 Buy Now
- Buyers may purchase a listing at its listed price using the "Buy Now" feature.
- Buy Now transactions can be funded via cryptocurrency or site balance.
- When funding via site balance, the full amount (including escrow fee) is deducted immediately from your available balance.
- By clicking "Buy Now," you confirm your commitment to complete the transaction.
- For YouTube channel transfers, buyers must provide a valid Gmail address during the purchase process.
3.5 Prohibited Listings
Listings that contain prohibited content or involve fraudulent, stolen, or misleading Digital Assets will be removed and may result in account suspension. See Section 9 (Prohibited Conduct) for the full list of prohibited content and activities.
3.6 Editing Listings
- Sellers may edit their listing details (description, price, attachments, etc.) at any time, provided the listing is not currently in escrow or sold.
- Editing an active listing will place it back into pending review. The listing will be temporarily unavailable to buyers until it is re-approved by our team.
4. Escrow Service
Fameclerk provides an escrow service to protect both buyers and sellers during account transfers. By using the escrow service, you agree to the following:
Legal Disclaimer: Fameclerk is not a licensed escrow agent, financial institution, payment service provider, or trustee. The term "Escrow Service" is a commercial designation used within the Platform and does not imply a regulated escrow or financial service under any applicable law. Fameclerk acts solely as a neutral intermediary facilitating transaction steps, communication, and dispute resolution assistance.
4.1 How Escrow Works
- Once a seller accepts an offer, the buyer can start the escrow and fund it via cryptocurrency or site balance.
- Buyers may also start an escrow directly using the Buy Now feature at the listed price.
- When funding via cryptocurrency, the buyer has 1 hour to complete the payment. If the payment window expires before the funds are received, the escrow is automatically cancelled and the listing becomes available again.
- Once funded, the seller transfers account credentials or ownership to our escrow agent for verification.
- After verification, the account is transferred to the buyer. Funds are released to the seller upon confirmation.
- The specific transfer procedure varies by platform (e.g., YouTube channel ownership transfer takes a minimum of 7 days).
4.2 Escrow Fees
The escrow service carries a fee based on the transaction amount:
Tier 1 · Micro
$0 – $100
$3 fixed + 7%
Tier 2 · Standard
$100.01 – $1,000
$5 fixed + 5%
Tier 3 · High Value
$1,000.01+
$15 fixed + 4%
When making an offer, the buyer may choose who pays the escrow fee:
- Buyer pays: The buyer pays the full escrow fee in addition to the offer amount.
- Seller pays: The escrow fee is deducted from the seller's payout.
- Split: The fee is split equally between the buyer and seller.
For Buy Now transactions, the escrow fee is always paid by the buyer. See Section 15 (Refund Policy) for details on fee refundability.
4.3 Escrow Limits
- Each buyer may have a maximum of 1 pending (unfunded) escrow at any given time.
- Each buyer is limited to 2 unfunded escrows per day (including pending, expired, or cancelled).
- These limits are in place to prevent abuse and ensure fair access to the escrow system.
4.4 Disputes
- Buyers may open a dispute if they believe the account received does not match the listing description or if the transfer was not completed as agreed.
- Dispute claims must include a written reason and may include supporting images as evidence.
- Our team will review disputes and make a resolution decision at our sole discretion. Our decision is final and binding.
- Possible resolutions include releasing funds to the seller, refunding the buyer, or a partial resolution.
5. Payments & Credits
5.1 Cryptocurrency Payments
- Fameclerk accepts deposits via cryptocurrency, including Bitcoin (BTC), Ethereum (ETH), Litecoin (LTC), USDT, and USDC across multiple blockchains.
- Network Fees: Fameclerk does not charge a fee for depositing. However, you are solely responsible for paying any blockchain network fees (miner/gas fees) required to send the transaction from your wallet.
- Cryptocurrency deposits are credited to your site balance based on the exact amount received by our wallet, converted to USD at the current exchange rate upon confirmation.
- You are responsible for sending the funds to the correct wallet address and network. Funds sent to incorrect addresses or unsupported networks cannot be recovered.
- Each deposit session is valid for 30 minutes. You must send the exact cryptocurrency amount to the provided wallet address within this window. If the session expires before payment is received, you will need to generate a new deposit with a fresh wallet address.
- Do not send funds to an expired deposit address. Wallet addresses are rotated after expiry, and funds sent to an expired address may not be recoverable.
5.2 Site Credits & Balance
- Fameclerk uses an internal credit system denominated in USD. Credits can be used to fund escrow transactions, feature listings, bump listings, and pin listings for additional visibility.
- Credits may also be purchased from verified credit agents through our agent marketplace.
- Escrow transactions can be funded directly via cryptocurrency or from your site balance.
5.3 Withdrawals
- Users may withdraw their available balance to a personal Ethereum (ERC-20) wallet address.
- A 2% processing fee is charged on all withdrawals.
- The minimum withdrawal amount is $10.00.
- Withdrawal requests are reviewed and processed by our team. We reserve the right to delay or reject withdrawals if we suspect fraud or policy violations.
- Once a withdrawal is processed and the transaction is confirmed on-chain, it is final and irreversible.
6. Messaging
- Fameclerk provides a built-in messaging system for buyers and sellers to communicate about listings and transactions.
- Messages must be used for legitimate purposes related to transactions on the Platform.
- You may not use the messaging system to harass, threaten, spam, or solicit users to transact outside of Fameclerk.
- We reserve the right to monitor, review, and store messages for safety, fraud prevention, and dispute resolution purposes.
7. Ratings & Reviews
- After a completed escrow transaction, buyers may leave a rating and written review for the seller.
- Ratings must be honest, accurate, and based on the actual transaction experience.
- Sellers may respond publicly to reviews they receive.
- We reserve the right to remove ratings or reviews that are fraudulent, misleading, defamatory, or that violate these Terms.
8. Notifications
- Fameclerk may send you notifications via email, browser push notifications, and/or Telegram regarding your account activity, transactions, messages, listings, and security alerts.
